€1.5M Debt Erased: Farmer Pays Under €20k to Creditors
High Court Approves Deal Writing Off €1.5m in Legacy Debt
A Westmeath farmer and contractor has had over €1.5 million in debt written off by the High Court in exchange for a lump-sum payment of less than €20,000. The Personal Insolvency Arrangement (PIA) allows the man to retain his family home and marks a resolution to financial difficulties stemming from the property crash of the late 2000s.
James McDonnell, aged 52, from Belvedere, Mullingar, found himself with debts totalling €1.7 million against assets of just €477,305. The court heard that Mr McDonnell, whose family had a background in auctioneering, had invested in several buy-to-let properties and a pub on professional financial advice.
Initially, the venture proved successful, with rental income largely covering the mortgage repayments. However, the portfolio’s viability collapsed with the onset of the economic recession. Widespread tenant defaults and prolonged vacancies left Mr McDonnell unable to service the loans, leading to the appointment of receivers and the eventual sale of the properties at a substantial loss.
The Path to Insolvency Resolution
The complex arrangement was presented before Ms Justice Nessa Cahill by barrister Keith Farry. It was formulated by Personal Insolvency Practitioner Gary Digney of AAB Accountants, who stated in an affidavit that the proposal maximised the means available to Mr McDonnell to ensure a fair return for his creditors.
Under the terms of the court-approved PIA, Mr McDonnell will retain his family home, valued at €460,000. The outstanding mortgage of €209,000 on the property will be restructured into a new 18-year term with a variable interest rate. This crucial provision prevents the family from losing their home.
To satisfy his other creditors, a lump sum of €30,000, raised through personal savings and a loan from a relative, will be paid into the arrangement. After the deduction of professional fees, a total of €19,791 will be distributed among the unsecured creditors.
A Minimal Return for Creditors
The settlement will see unsecured creditors receive just 1.3 cents for every euro they are owed. The main creditors in this category include Promontoria Aran Limited, an Irish subsidiary of the US fund Cerberus, which was owed over €1 million. A second entity, Mars Capital Finance Ireland DAC, was owed almost €500,000. The approval of the PIA effectively writes off the vast majority of the outstanding €1.5 million owed to these financial entities, allowing Mr McDonnell a financial fresh start after years of insolvency.
