Acceptance occurred when Fincham responded affirmatively on WhatsApp. Finally, the discussion of fees in the messages provided the necessary consideration. The judge dismissed the relevance of the unsigned formal subcontract, affirming that the contract had been formed via WhatsApp on 17 May.

The judge dismissed the notion that the digital format diminished the messages’ legal significance.
