Court Rejects Injury Claims of Two Men Due to Inconsistent Testimony

Two acquaintances who filed personal injury claims after their stationary car was allegedly “lightly touched” by a lorry on the M7 motorway have had their cases thrown out. The judge cited misleading testimony and a failure to reveal prior accidents as reasons for the dismissal.

Christian Carluccio and Leonid Iliev initiated legal action against Dungarvan Transport Ltd and its driver, Gruselionis Valdas, stemming from an event on 15th November 2018.

The claimants asserted that they had stopped on the hard shoulder to inspect a potential tyre puncture when their vehicle was struck by a lorry, causing them to sustain injuries to their necks, backs, and knees.

Although the defendants acknowledged responsibility for the incident, they contested the claimed severity of the collision and the genuineness of the injuries.
