Legal Claims Dismissed, Family Faces Substantial Costs

A family from Dublin, previously associated with 26 personal injury claims, is looking at a potential legal bill of up to €150,000. This follows the dismissal of six separate new claims for damages, totalling €360,000, against a motorist by a judge.

Absence in Court

Frank Gaynor, his wife Sylvia, both 60, and four of their family members, suspected of predicting the outcome of their recent cases, did not attend the Circuit Civil Court. Barrister Paul McMorrow reported to Judge Christopher Callan that the claimants, who alleged to have suffered whiplash injuries in a traffic accident seven years ago, failed to present themselves to further their cases.

Objections and Absenteeism

The Gaynor couple, residents of Drishoge Manor, Oldtown, north County Dublin, had objected to their lawyer’s decision to withdraw from their case, citing a breach of trust, in October last year. However, they haven’t been seen in the Circuit Civil Court since then.

Unsuccessful Challenge

Their lawyer had felt incapable of successfully challenging a full defence put forward by Allianz, the insurers of the motorist Brien Stenson, against whom the Gaynors made claims of causing a rear-ended collision. Their children Nicole (35), Jazmin (33), Frank Junior (33), and Reece (21) joined their parents in seeking damages up to €60,000 each, stemming from an accident near the Hilton Hotel on Malahide Road in April 2018.

Defendant’s Demand

Mr McMorrow, along with Karen Cahill of Nathaniel Lacy solicitors, told the court that the defendant wanted the Gaynor family to substantiate every single allegation made in their personal injury claims. It was alleged by Mr Stenson and his insurers that the extent of their injuries could not have resulted from the described collision.

Dismissal of Claims

Judge Callan noted that the cases were scheduled to be tried on May 7th, but there was no appearance from the claimant. The judge dismissed all the claims brought by the Gaynors and ordered legal costs against each one of them.
