Family Settles Legal Case After Rally Accident in Kerry

A young boy narrowly escaped severe injury during a motor rally in Kerry when a car lost control, crashing through a protective barrier and throwing his buggy against a wall. The High Court recently heard the details of this incident, which occurred a decade ago at a church car park in Ballymacelligott. At the time, Jamie O’Brien was watching the rally with his family when the accident happened, leaving him with facial and head lacerations.

Jamie, now 12, along with his sister Megan and their parents, recently settled legal actions stemming from the incident. Counsel for the family highlighted how Jamie was fortunate not to be strapped into his buggy during the accident. His legal case was resolved with a settlement of €75,000 due to the scars left on his head and over his eyebrow.

Jamie’s sister Megan, who was just seven at the time, suffered multiple injuries and was airlifted to a hospital. Standing next to her father when the car struck, she was pushed against the car park wall. Megan required four surgeries for injuries including a severe ankle degloving, fractures, and other trauma. After a month of hospitalisation, she recovered fully and her case was settled for €250,000.

Legal Proceedings and Settlements

The O’Brien family, hailing from Tralee, pursued legal action against several parties including the driver, the motor club, Motorsport Ireland, and the local council. The claims centred on alleged failures in safety protocols, the positioning and adequacy of barriers, and the overall safety planning for the event. All allegations were denied, with the defendants arguing the event was conducted under expected conditions for a rally.

Mr Justice Paul Coffey approved the settlements for both children, describing them as fair and reasonable. The terms of the settlements for the parents were not disclosed, and the case was formally closed. The judge expressed his best wishes to the family for their future.
