Garda Settles Case After Accidental Shooting Incident

A member of the Irish police force has come to a settlement in a legal case following an incident where he was accidentally shot in the leg when his submachine gun discharged. The officer initiated legal proceedings against the Garda Commissioner, the Minister for Justice, and the Attorney General, claiming the mishap occurred due to the gun snagging on his bulletproof vest while manoeuvring in a patrol vehicle.

The incident resulted in the garda suffering a shattered ankle, a consequence of the weapon discharging as he adjusted in a confined space. The court heard that the firearm’s safety switch and trigger were caught on his vest, leading to the accidental firing. The officer described experiencing intense pain, stating it was unparalleled to anything he had felt before, causing him to nearly lose consciousness.

The case was resolved on the third day of the hearing, with the officer’s counsel, Richard Kean SC, announcing the settlement to the court. The claim included allegations of failing to ensure a safe working environment, requiring the officer to carry a firearm in close quarters while wearing unsuitable protective gear.

The officer, with over 15 years of service, recounted the events of July 2019 when he was patrolling an area with a history of serious incidents, including shootings. He was operating a patrol vehicle, equipped with protective gear and firearms, including a pistol and a submachine gun. As he turned to check the rear seat, the gun discharged unexpectedly.

“The pain was immediate and severe,” he recalled, describing the sight of smoke and blood following the discharge. His colleague quickly secured the weapons, and the injured officer was transported to a hospital. Medical examinations revealed the bullet had penetrated his leg and shattered his ankle, necessitating surgery and extensive rehabilitation. The recovery process was prolonged, keeping the officer off duty for 18 months.

Despite efforts to rehabilitate, the officer noted that the pain persisted, impacting his recovery. The court proceedings remained confidential, with Ms Justice Denise Brett ruling that the identities of the officer and other garda witnesses were to be protected. During the hearing, it was confirmed that liability was acknowledged in the case.

The incident underscores the challenges faced by law enforcement officers operating in demanding environments and highlights the importance of appropriate safety measures and equipment.
