During the initial tribunal hearing, the respondent failed to appear, prompting Mr Nae to provide evidence to the adjudication officer, anticipating a further session. Mr Nae expressed concerns over the conduct of the proceedings, feeling that the questions posed were inappropriate.

Despite receiving two adjournment notices, Mr Nae was later informed that a decision had been reached, rejecting his complaint. This came as a surprise as he believed the case remained open, expecting a full hearing.

With backing from the Irish Human Rights and Equality Commission, Mr Nae sought a judicial review of the tribunal’s decision. The High Court granted leave for the review, leading to an agreement to annul the original decision and conduct a new hearing with a different officer.
